Teleworking and meal vouchers: the rules

Telework has been massively implemented in companies. Is the teleworking employee entitled to meal vouchers?

With the health crisis, teleworking has been massively introduced in companies. Is the employee entitled to his meal voucher on the day he teleworks?

A large majority of employees whose activities allow them to do so are currently teleworking. This means that they can have their meals at home. Do they receive a meal voucher on days when they work remotely from home?

The teleworker has the same rights as the employee who works on site, within the premises of your company (Labour Code, art. L. 1222-9). It is imperative that the employer respects the principle of equal treatment between the employee who performs his or her work remotely and the one who performs it on site.

Therefore, if your employees receive meal vouchers for each day worked, employees who telework should also receive them as long as their working conditions are equivalent to those of employees working on site.

To receive a meal voucher, the meal must be included in your employee's daily working hours. The same employee can only receive one meal voucher for each meal included in his or her daily working hours (Labour Code, art. R. 3262-7). Teleworkers therefore receive one meal voucher per day worked if their working day includes two shifts interspersed with a break reserved for a meal.

It should be noted that this rule applies to any telework situation, whether the employee teleworks from home or from a co-working space.
